ELIGIBILITY: This Contest is open to legal residents of the 50 United States and the District of Columbia, 21 years of age or older. Officers, directors, and employees of Contest Entities (as defined below), members of these persons’ immediate families (spouses, parents, children, step-children and siblings, and each of their respective spouses, regardless of where they reside), and/or persons living in the same households as these persons at least three months a year (whether or not related thereto) are not eligible to enter or win the Contest. Contest Entities, as referenced herein, shall include Diamond Foundry Inc, located at 731 S Spring St, Los Angeles, CA 90014, its respective subsidiary and affiliate companies, its administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Contest. Contest is subject to all applicable federal, state and local laws.
Contest PERIOD: Diamond Foundry’s Perfect Proposal Contest begins at 12:01 a.m. PT on August 13, 2018 and ends at 11:59 p.m. PT on September 7, 2018

HOW TO ENTER: To enter the Contest, during the Contest Period, visit perfectproposal.diamondfoundry.com (the “Website”) and follow the provided instructions to complete and thereafter submit the entry form, which includes your full name, zip code, telephone number and email address (the “Entry”). There is no cost to register or enter. Entries generated by script, macro or other automated means or practices, or by any means which subvert the entry process will be void. All Entries become the property of Sponsors and will not be acknowledged or returned.
Sponsor reserves the right, in its sole discretion, to: (i) verify any element of any entry, related materials or entrant’s eligibility; (ii) to request additional information; and (iii) to disqualify any entrant whose participation may subject the Contest, Sponsor or Sponsor's advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule. By entering this Contest, you agree to provide any documentation or information deemed necessary by, and in a form acceptable to, Sponsor to satisfy the above requirement if asked by Sponsor to do so.
By entering the Contest, Entrants agree to abide and be bound by these Official Rules and the decisions of Sponsor and Administrator, which shall be final, binding, and conclusive in all respects.

WINNER SELECTION AND NOTIFICATION:
All valid entries received during the Submission Period will be gathered into a database at the end of the Contest Period. A potential winner will be selected by a panel of judges and will be based on the creativity and feasibility of the proposal idea on or around September 28.
Potential winner will be notified via email and/or mail and will be required to complete and return a notarized Affidavit of Eligibility and Liability/Publicity Release and IRS W9 form within three (3) days of date of notification or an alternate winner may be selected in a random drawing from among all remaining eligible entries. If such documents are not returned within the specified time period, prize or prize notification is returned as undeliverable, Sponsor is unable to contact potential winner or potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected. Provided that a potential Winner is in compliance with the Official Rules and after having successfully proven eligibility and provided any documentation required by Sponsor, the potential Winner will be determined to be a Winner. Sponsor expressly reserves the right to delay the announcement of the Winners for any reason it deems necessary.
Sponsor reserves the right to select an alternate Winner in the event that any potential Winner fails to comply with these Official Rules. The potential Winner(s) also must have the guest who will accompany the potential Winner complete and sign a notarized Affidavit of Eligibility, release of liability, and a publicity release form (except where prohibited) and the potential Winner must return the same to Sponsor within the time period specified by Sponsor. The Contest Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected or unsuccessful efforts to notify the potential Winners.
Entry and acceptance of prize offered constitutes permission for Sponsor to use Prize Winner’s name, city, state of residence, likeness and/or photograph and statements for advertising/trade and all other purposes, in any and all media, and all media now or hereafter known worldwide in perpetuity, including the Internet and social networking sites, without further compensation, notification or permission, unless prohibited by law.
PROMO CODE DETAILS: Every entrant will receive an email from Diamond Foundry including a code redeemable for an upgrade worth up to $300 on any Diamond Foundry diamond engagement ring purchase.
One (1) Grand Prize Winner: The contestant who is judged to have the most creative and original proposal idea will win the Grand Prize. There may only be one Grand Prize Winner. The Grand Prize Winner is not eligible to be a "Runner-Up Winner", as described below.
One Grand Prize will be awarded comprising:
Two (2) Runner-Up Winners: Two Runner-Up Prizes will be awarded, each comprising one (1) Diamond Foundry ring with an ARV of up to $10,000; an original illustration by Alessandra Olanow; and a 250-word “love story” about their relationship written by Sylvia Day.
Proposal must be completed by November 9, 20187 or Prize will be forfeited.
The actual Approximate Retail Value (“ARV”) of the Prize may vary depending on the Winner's residence, market conditions, changes in value of components (e.g., air transportation and hotel rates) and other reasons. Sponsor is not responsible for, and the Prize Winner will not receive, the difference between the actual value of the Prize at the time of award and the stated ARV in these Official Rules or in any Contest-related correspondence or materials. Failure to complete any component of any Prize does not relieve the Prize Winner of his/her tax obligations associated with winning such Prize, if applicable. Specific travel arrangements and all prize details not specified herein will be made and determined in Sponsor’s sole discretion. Should travel be required, travel must originate from and end at the same airport, and Prize Winner and his/her one (1) guest (guest must be aged 21+ and Prize Winner’s guest must have a valid Passport with six (6) months validity should international travel be included) must travel on the same itinerary. It is the Prize Winner’s sole responsibility to comply with all travel requirements, which may include, without limitation, presenting necessary identification (including photograph) at the time of travel. Flight schedules are subject to change without notice. Sponsor is not liable for any missed prize events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. Prize Winner may be required to provide a credit card at time of accommodation check-in to cover incidentals. Sponsor will not be responsible if a Prize winner and/or guest fails to secure adequate travel documentation, is denied access to an aircraft or is denied entry into any destination outside the US (if applicable); in such an event, the Prize will be forfeited, in whole or in part.
ARBITRATION / RELEASES / INDEMNITY
Except where prohibited by law, as a condition of participating in this Contest, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or the prize awarded, shall be resolved individually, without resort to any form of class action; and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at a AAA regional office in San Francisco, CA; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages including attorney’s fees or any other damages, other than for entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and entrant further waives all rights to have damages multiplied or increased.
By participating in this Contest, entrants agree to release Sponsor and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Contest and each of their respective parents, agents, affiliates, subsidiaries, advertising and promotion agencies, and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, in whole or in part, directly or indirectly, from participation in this Contest and/or acceptance, use or misuse of the prize.
The Contest is governed by, and will be construed in accordance with, the laws of the State of California, and the forum and venue for any dispute shall be in South San Francisco, California; claims for bodily injury, personal injury, or property damage arising out of the redemption, use or misuse of any prize (“PRIZE CLAIMS”) must be submitted to the jurisdiction and venue of the federal and state courts of the State of California, and construed and enforced in accordance with the laws of the State of California.
Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Contest or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules.
Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, undelivered, garbled or misdirected entries or registrations; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prize, or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Sponsor reserves the right, in its sole discretion to disqualify any person tampering with the entry process, the operation of the web site or otherwise in violation of these Official Rules.
Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this Contest if the Contest is compromised by virus, technical corruption, non-authorized human intervention, or any other causes which, in the sole discretion of the Sponsor, corrupt or affect the administration, security, fairness, proper play or integrity of the Contest. In the event of cancellation or termination, Sponsor reserves the right to select the potential winner from among all eligible, non-suspect entries received and combined prior to date of cancellation or termination. In the event of a dispute regarding online entry, entry will be deemed made by the authorized account holder of the e-mail account associated with the entry and he/she must comply with these Official Rules. The authorized account holder is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning email addresses. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS Contest IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

To maintain an element of surprise for the Winner’s significant other, Winner will be announced publicly after their Perfect Proposal has been brought to life by Sponsor.
